So umm What happened?  I lost the ability to internet for a while and .....   Everything is gone?

About 2 years ago...  Skyhigh said to save anything you wanted to have access to, S7 is going down for awhile.  About a Year Later S7 came up again in its present format.

The reason why is the previous version of S7 wasn't compatible with new servers.

I'm really hopping to get a backup copy of the previous S7 someday.

Ahh....  Well...  That makes sense..  ( Hey Thunder!!!!)   Anyway... I missed the post about saving stuff, luckily I didn't have too much of anything that wasn't re-doable.. Or already backed up on a computer somewhere.  ( except for the recipe for the Blue Stuff)     I can still figure that one out in a bit.

That seems rather disingenuous considering our Wendsday evening conversation, two days ago.

 

Warlock was actually waiting for me. He wanted to know "who I was" and "why I was posting his designs."

My response was to ask him if he objected to his work being recovered. I pointed out that a number of writers to the preCrash Solaris7 had made enquiry to whether or not someone/anyone had saved their lost work. Warlock replied that he was actually OK with it, It's just that he wanted to be asked first. That was the end of our discussion.

I was rattled by it. I never imagined that anyone would not want their work recovered. I didn't want to be accused down the road of misapproriating anyone's intellectual property. So I deleted my posts, AFTERWARDS, relating to the revovered Lost Solaris7 files. I assumed by this time that anyone on the board who had lost material and had a chance to view my posts would have made made their own copies by now. I'm glad to have helped anyone that I could.

After having more time to think about it, there probably was no need to take such a drastic step on my part. When you all posted to Solaris7, you did so knowing that WizKids owned the Battletech name and all the story inventions connected there with. That WizKids had given Solaris7 permission to use names and artwork for information purposes. That you were creating and disseminating your Fan Fiction with the expectation and understanding that it would be viewed, downloaded , communicated, and shared for free. You all knowingly put it in the public domain with virtually no restriction at all. Furthermore, all of my posts were fully attributed. I did not alter or attempt to misrepresent the subject mater. So there is nothing wrong with Warlock communicating that he would have liked to be asked first but he had no right to require that permission.

As you all know, it took some months to post all that recovered info. My plate's kind of full right now. Unless SkyHigh or the moderators decide it's not appropriate for Solaris7, I could probably get around to reposting what I saved but it will be sometime before I have the time. In the meantime, I urge anyone who lost material and is desirous to get it back to scour the Way-Back Machine before that goes belly-up.

Lasergunner, I don't have any issue with you re-posting material from before the wipe, but as raised by Warlock, you may want to reach out to members before re-posting their stuff (those that have re-joined, at least; those that haven't, it has certainly been long enough and if they haven't stumbled by yet...). My posts are probably the sole exception, since 90% of my work was the canon TROs. I'll take this moment to say that you have my permission to also post any of my other personal designs.

 

Feel free to PM me with any questions or concerns, I only check in once in a while and may miss a post here.

For starters, this shows that this site needs to post some guidelines about re-posting material from the pre-crash Solaris7; what's permissible? what's not?. If as part of those guidelines, you want permissions then it might make sense to have a Go-To thread where the Armory Designers can post their permission. 

A number of people had posted that their particular memory storage device had given out and were asking if anyone else had saved their stuff.  Such remarks may be considered permissions but it's not really helpful because those remarks will just become part of the larger conversation. In order to avoid disputes, there should one thread specific to that purpose.

I Don't mean to step on any toes but that material appears to be now firmly in the public domain. You. meaning any of the "Designers" who posted that material to Solaris7, knew that it would be freely viewed/used/downloaded/printed/copied/&shared.  It does not appear that a license or limited license was required of anyone who downloaded said material. I think it's understood that someone couldn't collect it and sell it and that it was available for private use. Nowhere does it appear to be stated that their is any restriction on the material and the use there of. Nowhere on the downloadable document does it indicate any Copyright protection. In effect, you already gave your permission when you posted it for public consumption. With respect, am I missing something?

I wasn't around much anymore before the old site was taken down, but I've been checking in every so often since it came back.

I never saw any issue with what you were doing. Everything was quite clearly labeled who's designs they were. Even had their armory name.

You didn't seem to have (or just never got around to any of mine), but that prompted me to go looking for them.

I actually recently found all my old designs on a flash drive. I don't recall which ones exactly I had in Mike's Mechworks, but I recall some of them. Unfortunately some of the ones that I know were there do not have their fluff in their .hmp file, and I haven't been able to find it on the laptop I was using back then (which surprisingly enough not only do I still have, but it still works).

That the re-posted material is attributed to it's author should be part of any guidelines.

 

Fabrizio: I'm glad to hear you were able to find your old files. As you probably already know, the WayBack Machine has it's limitations. Sometimes you can get armories and sometimes not. Sometimes you can reach the armory but not the designs in the armory. I found that if you go into "New Additions" you can sometimes pull up designs there even if the armory is unreachable.

Lasergunner would you not be curious as to who was posting your stuff? Now i have not log on S7 for awhile, and what do i see when I do, but a block post with some hand pick designs of mine. I was more then a little surprised. And I do think it was wrong of you to post other peoples designs with out even asking them.

Dont get me wrong, I realy dont have a problem with you post my designs, but at least ask before doing so. I dont think that it is much to ask.

Hell if you could post all my designs it would be great, seeing that the HD I had all my mech files got toasted. lost all my SSW files.

This question really does cut to the heart of whether or not someone can re-post a work of Fan Fiction that was promulgated by Solaris7. This can apply to anybody. Was it yours? You might readily answer "yes, I wrote it!" But legally do you own it? Legally can you exert any control over it?

WizKids gave permission to Solaris7 to use their copyright protected material for "promotional and informational purposes." Solaris7 operated for many years. Solaris7 would have undoubtably outlined how that permission would be used. The LLC would have told Solaris7 how the permission could be used.The copyright owner(s) presumably monitored Solaris7 from time to time. They would have been aware that the website hosted and facilitated Fan Fiction writers. The material that we refer to as designs and as the fluff are works of Fan Fiction with the exception of any fiction contributed by the copyright owner(s) for "promotional and informational purposes." Said permissions would imply that the copyright holder extended to the various Solaris7 authors a license to write their Fan Fictions under the for "promotional and information purposes" permission granted to Solaris7.

Because it's fan fiction it is considered  a derivative work. Battletech is a property of who ever owns the copyright for Battletech. Only the copyright owner has an automatic right to create derivatives of their intellectual property. It is evident that because you were able to post your Fan Fiction to Solaris7 that the permission from the copyright owner was extended to you for "promotional and information purposes."

Fan Fiction is not original work because you are working off of underlining story lines, concepts, and literary inventions owned by the copyright holder. Furthermore, in almost all the designs I saw, there was attribution to some program/application like DBM (the Drawing Board File). Unless you are the copyright owner of the program which itself would be a derivative of Battletech then any designs would also be derivative from that as well as from Battletech. Because you licensed your work from the copyright owner, you do not gain copyright on the original work from which it is derived. You are only extended the right to author a derivative work; the Fan Fiction. The copyright on the original work is not extended to the derivative work; the Fan Fiction.

As I stated earlier, you put this material on Solaris7 with the knowledge that it would be freely accessed, viewed, downloaded, copied, and communicated! Once you published it on Solaris7, you had no control over where it went.

If thats the way you you want to do it find, be an asshole, do what you want and , and screw everybody else.

 

Where I come from it would have been common courtesy to ask before posting someone else designs. Just because you can, does not mean you should.

Solaris7 is a privately owned property. It is run however the owner sees fit. So as far as what is courtesy on the site is determined by the rules and guidelines set by the management. If the management wants permissions of it's authors or to set other guidelines before anyone else who is not the author of the derivative work to be posted reposts derivative works then it should do so. Do you have any argument with that?

Oh for crying out loud, If all you are going to do is hide behind that then there is no reason to talk to you. You might as well just say, " There is no rule that says I cant so that means I can!" Just like any other 5 year old.

I have never had a problem with anyone using my designs, hell i hope some one out there though at one point " Wow, that Warlock sure made some good designs." Hell, that would make my day. I hope there are some of my designs out there right now on other peoples computer, because they like using them, that would make me very happy.

But reposting my designs with out so much as asking me if it was ok, that is another matter. Would it realy have been so hard for you to do that? I do not care what the permissions and guidelines are, at the end of the day they are my designs, and you should have used 5 minutes to send me a mail and ask if it was ok to repost them. If you had done that, I would have been fine with it, hell i would have ask if you could get all of them and send them to me.

But you could not be bothered with that, because there where no rules about that, so that means you could, in your world anyway.

Like I said before, just because you can, does not mean you should. If you cant under stand that, then there is no reason to discuss this with you anymore.

I offered the supposition that WizKids may have monitored Solaris7 up to the time the site crashed. It's not unreasonable that they would want to look out for their own interests. They might even have looked upon the site as laboratory for creative ideas to pursue and as a potential pool of talent to recruit from. Have any of the Armory Designers approached or considered approaching that company to inquire if they did monitor and if they "made their own copies of all the creative material" encapsulated by Solaris7?

Rebuilding from scratch. Not out of the question Laser Gunner. Some of the refits from the new mechs in a TRO remind me of something was do. No problem by me.

... Says the guy who goes on to complain bitterly when someone fulfills his wish.  What a hypocrite; especially considering that anyone with access to the BattleTech construction rules could have come up with "his designs".  Besides, if you didn't want people to view and use "your" content, then why did you post it in a public forum like an Armory in the first place? 

If everyone truly wants an Armory functionality again, as I do, then we should be rejoicing that someone is trying to repost what was lost.  The Way Back Machine is incomplete at best, with most of the actual content not preserved as far as I can tell.  So, all hail the "Lasergunner Memory Core", I say!

The Dropship has touched down and I can hardly believe that almost two years have gone by. I'm willing to give this another go. 

When last I posted, I had the benefit of a broadband internet connection; not so much now! I was hoping to see something in the way of "guidlines" by this time.
